HES Exemptions

A homeowner can apply for an exemption to the home energy score program, if the sale of the home is due to a situation indicative of financial distress. For a home to be exempt, the homeowner must fill out an exemption application and receive confirmation of exemption from the city. 

Transactions that MAY BE EXEMPT from the requirement include:

  • Trustee’s sales.
  • Deed‐in‐lieu of foreclosure sales.
  • Pre‐foreclosure sale in which seller has reached an agreement with the mortgage holder to sell the property for an amount less than the amount owed on the mortgage.

Foreclosures and bank-owned home sales are not exempt and must receive a home energy score at time of listing if the home is of an applicable building type. See HES for Homeowners  for more information.

There are other sale circumstances that may qualify for exemptions as defined in the Milwaukie Residential Energy Performance Rating and Disclosure Code

Apply for a Milwaukie Home Energy Score Exemption
To apply for an exemption, a homeowner must answer all the required questions on the exemption form, including selection of one of the potential exemptions from the full list of possible exemptions outlined in the Milwaukie Residential Energy Performance Rating and Disclosure Code, and submit supportive documentation as proof. Submit your exemption application at least 10 days prior to listing your home for sale.

Upon receipt of the exemption request, the city will provide a receipt to acknowledge receiving the exemption request. The city reserves the right to verify documentation within 10 business days and to issue a written decision when approving or denying a request for exemption. The absence of any written response is an approval of the request.

Please remove all sensitive information, including bank account information and social security numbers from any documentation sent with the HES exemption form. Supportive documentation must include reference to the address of the home applying for an exemption.

Once completed, send the HES exemption form and supportive documentation to the City of Milwaukie through the following options:

  • Drop off the completed HES exemption form and supportive documentation at Milwaukie City Hall at 10722 SE Main St., Milwaukie, OR 97222
    • Please make sure that your contact information and the address of the home applying for an exemption are prominently located on the documentation form.
       

Please note that all exemption applications sent to the City of Milwaukie and the information contained within are subject to the PUBLIC RECORDS LAW DISCLOSURE, and while the city will work to maintain confidentiality for all information submitted for an exemption application, the application is subject to public disclosure unless exempt from disclosure under Oregon Public Records Law.
